1. Roles and Responsibilities

This website (the "Site") is owned and operated by Olivier Tétreault ("Site Operator"). Content published on the Site — including text, images, video, and blog or listing content — is added, selected, and managed by the Site Operator, including through content management and publishing tools provided by EstateFunnel Inc. ("Platform Provider").

Platform Provider furnishes the underlying hosting and technology infrastructure at the direction of the Site Operator and does not create, select, or exercise editorial control over Site content, except where expressly identified as platform-generated (e.g., certain AI-assisted content tools). Platform Provider administers the notice-and-notice process described below on behalf of the Site Operator, as required under the Copyright Act (Canada).

Platform Provider makes available AI-assisted content creation tools that Site Operator may choose, at its discretion, to use for generating or supplementing text, images, and video on the Site. Site Operator determines whether, when, and how such tools are used, and remains responsible for reviewing and approving all content prior to publication, regardless of whether individual items are labeled as AI-assisted.

2. Notice of Claimed Infringement

Canada’s "notice-and-notice" regime (Copyright Act, sections 41.25 to 41.27) allows a copyright owner to send a notice of claimed infringement regarding content on the Site. To be valid, a notice must be in writing and include:

3. Forwarding of Notices

Upon receipt of a valid notice, Platform Provider will, as soon as feasible, forward the notice electronically to the Site Operator and will inform the claimant when the notice was forwarded. If Platform Provider is unable to forward the notice, it will inform the claimant of the reason why.

4. No Obligation to Remove Content

Unlike some other jurisdictions, Canadian law does not require Platform Provider or the Site Operator to remove or disable access to content solely because a notice of claimed infringement has been received. Receipt of a notice does not constitute a determination that infringement has occurred. The Site Operator may, at its discretion, review and remove content in response to a notice, and content may also be removed if required by a court order or under the Site’s Terms of Use.

5. Record Retention

Platform Provider retains records sufficient to identify the person to whom the relevant electronic location belongs for six months from the date the notice is received, extended to twelve months if the claimant notifies Platform Provider, within that six-month period, that they have commenced proceedings related to the claimed infringement and provides evidence of that fact.

6. No Fee Charged

Platform Provider does not charge a fee for receiving or forwarding a notice of claimed infringement under this policy.
